Terms for using Callcard Express

Callcard Express provides businesses with a way to send callers a secure SMS link so callers can enter contact and service details during a live phone conversation. These Terms of Service govern access to and use of the Callcard Express website, receiver portal, caller forms, and related messaging features.
Acceptance of these terms
By accessing or using Callcard Express, you agree to these terms. If you are using the service on behalf of a company, department, or other organization, you represent that you have authority to bind that organization to these terms.
What the service does
Callcard Express is designed for billing teams, sales staff, receptionists, service coordinators, intake teams, and other personnel who need to collect accurate caller information quickly.
The service allows an authorized business user to create a short-lived request session, send a secure SMS link to a caller, and receive the information the caller chooses to submit through that session.
We may add, change, or remove features from time to time as we improve the service.
Accounts and authorized use
- You must provide accurate account information and keep login credentials secure.
- You are responsible for activity that occurs under your account, including use by your employees, contractors, or other authorized personnel.
- You may use the service only for lawful business communications and legitimate customer interactions.
- You may not share access with unauthorized users or attempt to bypass service restrictions or security controls.
SMS messaging terms
Callcard Express includes toll-free or similar SMS delivery features used to send secure form links to callers. You are responsible for using messaging features in compliance with applicable laws, industry rules, and carrier requirements.
You must obtain the level of consent appropriate for the type of message you send. For operational text messages tied to an active customer interaction, your practices should clearly inform the caller that they will receive a message from your business.
Recipients may reply with carrier- or provider-supported keywords such as `STOP`, `START`, `UNSTOP`, or `HELP`. Carrier message and data rates may apply. Additional information about SMS consent and opt-out handling is available on our Opt-In page.
You may not use Callcard Express to send spam, unlawful marketing messages, deceptive content, phishing attempts, or messages unrelated to the caller interaction for which the number was provided.
Caller information and your responsibilities
Callcard Express is built to support short-lived collection and display of caller-submitted information during an active session. The platform is not intended to serve as a long-term system of record for caller personal data within the caller workflow itself.
If you copy, export, or enter caller information into your own CRM, billing, medical, support, or other internal systems, you are responsible for that downstream handling and for complying with the privacy, security, and retention rules that apply to your organization and industry.
You agree not to use the service to collect or handle information in a way that violates law, breaches confidentiality obligations, or exceeds the scope disclosed to the caller.
Prohibited conduct
- Using the service for unlawful, fraudulent, abusive, or misleading activity.
- Sending text messages without appropriate consent or to numbers you are not permitted to contact.
- Uploading malicious code, probing vulnerabilities, or interfering with the integrity or availability of the service.
- Using the service to collect highly sensitive data unless your use is legally permitted and your internal processes are appropriate for that information.
- Reverse engineering, copying, reselling, or exploiting the service except as permitted by law or by our written approval.
Third-party services
Callcard Express relies on third-party providers for hosting, authentication, database services, and SMS delivery. Availability and delivery may be affected by those providers, network operators, mobile carriers, browsers, and devices. We are not responsible for delays, blocking, filtering, or outages caused by third-party systems outside our reasonable control.
Availability and no emergency use
We aim to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation.
Callcard Express is not an emergency communications service and should not be used where failure, delay, or non-delivery could create risk of injury, emergency response failure, or other time-critical harm.
Fees and suspension
Paid features, subscriptions, usage limits, or billing terms may be presented separately in an order form, pricing page, or customer agreement. If there is a conflict, the specific commercial agreement controls for those items.
We may suspend or limit access if we reasonably believe your use creates security risk, violates these terms, triggers carrier or provider complaints, or exposes us or others to legal or operational harm.
Disclaimers
To the extent permitted by law, Callcard Express is provided on an `as is` and `as available` basis. We disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee SMS delivery, carrier acceptance, data accuracy supplied by callers, or that the service will meet every regulatory requirement applicable to your business use.
Limitation of liability
To the extent permitted by law, Callcard Express and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising out of or related to the service or these terms. Our total liability for claims arising out of or related to the service will not exceed the amounts paid by you to Callcard Express for the service during the twelve months preceding the event giving rise to the claim.
Privacy
Your use of the service is also subject to our Privacy Policy, which describes how we process account information, session information, and short-lived caller data.
Changes and contact
We may update these terms from time to time. When we make material changes, we will update the effective date on this page.
